KFYO News learned Monday afternoon that Precinct 4 Lubbock County Constable C.J. Peterson agreed to a plea deal with the Lubbock County District Attorney's Office concerning a DWI charge against him.

Peterson, back on May 6, 2018, had been charged with Driving While Intoxicated in connection with an accident that occurred in the 5400 block of 50th Street in Lubbock. It was determined that Peterson's blood alcohol content level at the time of the accident was 0.152, almost twice the legal limit of 0.08.

On Monday morning, Peterson pleaded guilty to a Class B Misdemeanor in connection with the DWI charge. Peterson will also resign immediately from his elected office as Lubbock County Constable and voluntarily surrender his Texas Peace Officer License.

By resigning from elected office, Peterson nullifies a petition filed earlier this year by Lubbock County Republican Party Chairman Steve Evans. The petition sought to remove Peterson from office because of the DWI charge.

Peterson will be sentenced at a future date and the Lubbock County Commissioner's Court will select a replacement for Lubbock County Constable, Precinct 4. Peterson's term in office was set to end in December 2020.
