What's the law?

Under Texas Penal Code Title 9, the state once limited how many adult toys you could legally own—six, to be exact. If you got caught breaking that rule, you could face up to two years in prison and a $10,000 fine. No joke. It's a law about the number of “obscene devices” you can own.

This isn’t just some dusty old rule no one paid attention to. In 2004, a Dallas woman hosting a “Passion Party” (think Tupperware party but for adult items) was charged with violating this law. Thankfully, the charges were dropped, but the case put Texas’ quirky law into the spotlight with several news outlets reporting the story.

What about Lubbock?

Lubbock even had its own moment with this law in 2007, when police raided Somethin’ Sexy, a lingerie shop, after complaints about their adult toy sales. Once again, charges were dropped, but it left a lot of folks scratching their heads—and probably double-checking their nightstand drawers. You don't want to get arrested and wind up on Lubbock County Mugshots. That would be quite embarrassing!

In 2008, a federal judge declared the law unconstitutional and essentially unenforceable, but the rule is still technically on the books. So, even though the law has lost its bite, it’s a reminder of how wild Texas can be sometimes.

Texas loves its quirks, but limiting how many adult toys you can own? That’s a head-scratcher even by Lone Star standards. What’s next, a law about how many cowboy hats you can own? Only in Texas, y’all.
