The family of Jan Whitaker, a Lubbock man who died after crashing along North Loop 289 near University, is suing the Texas Department of Transportation and several TxDOT contractors for $1,000,000.

KAMC News reports that back in September of 2017, Whitaker was riding his motorcycle along North Loop 289 while it was under construction. The lawsuit says that the University Avenue exit was open and there were no signs, barricades, cones or barrels preventing anyone from taking the exit.

Apparently, there was uneven pavement, and Whitaker was thrown from his motorcycle after he struck the elevated edge of the exit ramp. He later died due to the injuries he sustained.

TxDOT and the contractors have yet to file their side of the story in court records.
