Earbuds are really popular right now. My friend can barely function without his. He pretty much wears them 24/7. When one goes missing, he loses his mind. He even wears them when he's driving and I've often wondered if he could get in trouble for it. What if he doesn't hear another driver honking? What if they block out the sound of a siren from a quickly approaching ambulance? It worries me.

So, is it actually legal to wear headphones behind the wheel of a vehicle in Texas?

It's kind of crazy, but it isn't illegal to wear headphones in your ears while you are driving in Texas. However, you can still get a ticket or a citation for "dangerous driving" for wearing them on the road. That doesn't really make a lot of sense to me, but it is what it is.

According to KRW Lawyers, "Wearing headphones while driving is one of the most dangerous things you can do while behind the wheel."

So why isn't it illegal?

Many people would argue that using the hands-free Bluetooth feature for phone calls on the road is much safer than holding your actual cell phone. That might be one of the reasons it isn't illegal. It also could be a law that just hasn't been updated since the recent growth in earbud popularity.

In any case, the best way to avoid getting a ticket or accidentally causing an accident is to not wear them while you're driving. If you just can't live without them, consider only wearing one, and leaving the other ear open in the event of an emergency.
